Family Law Property Settlement

Family Law Parenting Agreements

A parenting agreement can provide parents and children with certainty, routine and structure. It can also minimise any potential conflict that may arise in the future. We will provide you with personalised advice on how you can navigate the pathways that are available to try and finalise your parenting agreement peacefully, privately, and amicably, and outside of the disputed Court process if possible.

Divorce Applications

An Application for Divorce is lodged online in the Federal Circuit and Family Court of Australia. Divorce Applications can be me made by a sole applicant, or both spouses can apply as joint applicants. You can lodge your own Application as a self-represented Applicant, or you can engage a Lawyer to lodge and finalise the divorce proceedings for you.

In your divorce, we can help:

  • Prepare the Application for Divorce

  • Arrange for service of documents on your former spouse

  • Obtain your Divorce Order from the Court

Wills and Enduring Power of Attorney

If you have a valid Will, you can take comfort in knowing that your wishes are in place and are documented legally, to protect the future of your loved ones.

We can also assist you in preparing or updating your Enduring Power of Attorney document. This can be one of the most important legal documents that you will ever sign. In that document, you can appoint a person or people you trust, so that they can manage your financial matters and personal/health affairs at some time in the future, for example if you are too unwell to make decisions for yourself.

In preparing your estate plan, we can help:

  • Prepare a valid Will

  • Prepare a valid Enduring Power of Attorney

  • Prepare an Advance Health Directive form

  • Guidance in binding death benefit nomination forms for superannuation

Estate Administration

When a loved one dies, you do not want any more stress or complications in trying to navigate the estate administration process. Our goal is to help you find peace of mind, and to administer the estate efficiently and effectively, so that everyone has a clear understanding of the process.

In the administration of a deceased estate, we can help executors and administrators:

  • Apply for a Grant of Probate of the Will (or if there is no Will, apply for Letters of Administration on an intestacy)

  • Deal with any jointly owned assets

  • Transmission of estate property to the legal personal representatives

  • Collecting in estate assets

  • Transfer of assets to beneficiaries named in the Will

  • Distribute the estate to the beneficiaries.

Wills & Estate Disputes

Will disputes often involve either:

  • Family provision claim - where an eligible person (being a spouse (including de facto spouse), child (including step-child) or financial dependant of the deceased person) claims that adequate provision has not been made for them out of the deceased’s estate

  • Will validity disputes e.g. capacity disputes

In a deceased estate dispute, we can help:

  • Provide advice as to the dispute process and potential outcomes

  • Negotiate with the other party (or their lawyer)
